Terms and Conditions Regarding Art Sales

1. INTRODUCTION AND OVERVIEW
Welcome to the official Terms and Conditions (“Terms”) governing all sales of digital artwork by Lux von Zollern Consulting Corporation (“we,” “us,” “our,” or “Lux von Zollern”) through our official website, lvzprestige.com (the “Website”). These Terms constitute a legally binding agreement between Lux von Zollern and any individual, purchaser, or entity (“Purchaser,” “you,” or “your”) engaging in the acquisition of digital artwork from us.
By purchasing digital artwork from Lux von Zollern through this Website, or through communication initiated via our official contact email luxvonzollern@gmail.com, you acknowledge that you have read, understood, and agreed to be bound by these Terms in their entirety. If you do not accept these Terms, do not proceed with any purchase.
These Terms govern all elements of the transaction, including payment, delivery, ownership rights, and limitations. They are designed to protect the integrity of the purchase, the exclusive rights of our clients, and the prestige of the Lux von Zollern brand.
2. FORM OF ART OFFERED
All artwork listed on lvzprestige.com is sold as digital compositions. By design and on purpose, all art pieces in the Lux von Zollern collection are composed and intended to be displayed in high-resolution digital format. They are optimized for presentation on:
- Digital picture frames
- Flat screen televisions
- Desktop monitors
- Tablets and professional screens
Lux von Zollern does NOT offer, provide, or ship physical canvases, paper prints, posters, photographs, or original painted works. Purchasers are NOT buying tangible artwork. Instead, you are purchasing exclusive access to professionally rendered, high-resolution digital art files delivered via electronic media as described below.
Each purchase includes the electronic artwork in multiple sizes and formats. Upon completion of payment, the following versions of the artwork will be generated:
- File Sizes: 500 MB, 100 MB, 50 MB, 10 MB, 5 MB, and 1 MB
- File Formats: PNG and JPG (in each size listed above)
These files are designed to accommodate varying display preferences and device capabilities, ensuring that the Lux von Zollern artwork retains its luminous depth, intricate detail, and vibrant color regardless of viewing platform.
3. PAYMENT METHODS
Given the exceptional price point and value of Lux von Zollern digital artwork, payment is accepted through the following two methods only:
a. Credit Card
Credit card payment is available at checkout through our secure processing system. By choosing this option, the Purchaser agrees to provide all necessary billing details, including name, billing address, and valid credit card information. Transactions will only be completed once verified by the credit card issuer.
In the event of a failed transaction or suspected fraudulent activity, Lux von Zollern reserves the right to cancel or pause the order until proper verification is completed.
b. Wire Transfer
As an alternative to credit card payments, Purchasers may opt to complete payment by wire transfer. To initiate a wire transfer, please contact us directly at luxvonzollern@gmail.com to receive the official wiring instructions, including banking details, payment references, and procedures.
Wire transfers are ideal for clients preferring direct and secure bank-to-bank transactions, especially for high-value purchases. Lux von Zollern is not responsible for any wire transfer fees incurred by the Purchaser.
IMPORTANT: Wire transfer instructions will only be shared via the above email and must be requested by the Purchaser. We strongly recommend double-checking all wiring instructions before sending any funds.
4. PURCHASER INFORMATION REQUIREMENTS
To facilitate the timely preparation and secure delivery of your purchase, the Purchaser is required to email the following personal details to luxvonzollern@gmail.com immediately upon completing payment:
- Full Legal Name
- Complete Mailing Address (no P.O. boxes)
- Valid Contact Phone Number
This information is necessary to prepare, label, and ship the external storage device containing your digital artwork files. All customer data is kept confidential and used exclusively for order fulfillment and customer service purposes in accordance with our Privacy Policy.
Failure to provide accurate and complete contact information may result in delivery delays. Lux von Zollern assumes no responsibility for delayed or misdirected shipments resulting from incomplete or incorrect customer details.
5. DELIVERY METHOD AND TIMELINE
Upon receipt and full verification of payment—whether by credit card or wire transfer—Lux von Zollern will prepare your digital art purchase for delivery. This involves generating and saving the art files in various formats and sizes, as described above.
a. External Secondary Drive
Lux von Zollern will save all associated digital files onto a 1 Terabyte external secondary drive, prepared specifically for the Purchaser. This drive will include all formats and sizes of the purchased digital artwork, securely packaged for safe transport.
b. Shipment Timeline
We commit to shipping the prepared external secondary drive to the Purchaser within three (3) business days of the confirmed receipt of funds into Lux von Zollern’s bank account.
All shipments are made via international courier service (such as FedEx, DHL, or UPS). Once shipped, the Purchaser will receive an official tracking number and courier information via email.
c. Delivery Address
The shipment will be sent to the exact mailing address provided by the Purchaser in writing via email. It is the Purchaser’s sole responsibility to ensure the accuracy of this address prior to shipment. Lux von Zollern is not liable for any courier mishandling, failed deliveries due to address errors, or unclaimed shipments.
d. International Shipments
Please note that international orders may be subject to customs processing, import duties, or taxes. These fees are the sole responsibility of the Purchaser. Lux von Zollern does not cover customs duties or related taxes.
6. NATURE OF PURCHASE – DIGITAL FILES ONLY
When you, the Purchaser, complete your transaction with Lux von Zollern, you are purchasing a set of professionally generated digital art files composed and formatted exclusively for digital display. These files are provided on a physical storage medium—specifically, a 1 Terabyte external drive—as described in Part 1.
It is important to re-emphasize and confirm your understanding that:
- You are not purchasing a print, a canvas, a painting, a poster, or a tangible visual artwork.
- You are purchasing electronic files of the selected Lux von Zollern artwork and the corresponding external drive onto which they are saved.
- These files are professionally rendered and curated for optimum brilliance on digital picture frames, LED screens, OLED displays, flat-screen TVs, desktop monitors, and high-resolution tablets.
Lux von Zollern’s artistic vision, by design and intention, favors digital light projection, which brings out the luminous depth, vibrant contrasts, and subtle textures within each composition—effects that are diminished or lost when printed.
The digital nature of this purchase is fundamental to the Lux von Zollern brand. The unique format enhances the buyer’s experience and preserves the integrity of the artist’s original intent.
7. LICENSING RIGHTS AND INTELLECTUAL PROPERTY
All digital artworks offered by Lux von Zollern remain the intellectual property of Lux von Zollern, protected by applicable international copyright laws and intellectual property treaties. Upon purchase, the Purchaser is granted a non-transferable, non-exclusive license to display the purchased digital artwork files for personal, non-commercial use only.
a. What You Are Permitted to Do:
- Display the artwork on your personal devices, including digital picture frames, screens, and media installations.
- Showcase the artwork in your private residence or office, for your enjoyment or that of your guests.
- Store copies of the files for backup or transfer across your owned devices, without altering them.
b. What You Are NOT Permitted to Do:
- License, or sublicense the artwork files to any third party without explicit, written permission from Lux von Zollern.
- Use the artwork in any commercial, promotional, or advertising context without explicit, written permission from Lux von Zollern.
- Modify, alter, or edit the digital artwork in any way.
- Upload the artwork to websites, public forums, or digital galleries where it can be copied, downloaded, or redistributed for the purpose of mass re-distribution.
- Mint or convert the artwork into NFTs (Non-Fungible Tokens) or use it in any blockchain-based digital representation.
Violation of these terms constitutes a direct infringement of intellectual property rights and will result in legal action.
8. REFUND POLICY
Due to the nature of digital art and the high-value nature of each transaction, Lux von Zollern does not issue refunds under any circumstances.
We encourage all Purchasers to carefully review the artwork, understand its format, and confirm their desire to acquire the digital version before proceeding with payment.
By completing your transaction, you acknowledge and agree that:
- You are purchasing a digital product delivered via physical external storage.
- You have received a full explanation of what your purchase entails.
- You accept that all sales are final and no refunds will be provided once the transaction has been processed.
This no-refund policy ensures the exclusivity, fairness, and protection of Lux von Zollern’s collectors and intellectual assets.
9. EXCHANGE POLICY
Lux von Zollern understands that in rare cases, a collector may wish to substitute one piece of digital artwork for another. Therefore, we offer a one-time exchange opportunity, under specific terms and limitations.
a. Eligibility for Exchange
- The request for an exchange must be initiated by the original Purchaser only.
- The exchange request must be submitted via email to luxvonzollern@gmail.com within ninety (90) calendar days from the date of the original purchase.
- Only one (1) exchange is permitted per transaction. Multiple exchanges are not allowed.
b. Conditions for Exchange
- The artwork selected for exchange must be of equal or lesser value to the original purchased item.
- If the newly selected piece is priced lower than the original, no credit or refund will be issued for the price difference.
- If the newly selected artwork is of higher value, the Purchaser will be required to pay the difference in full before the exchange can be processed.
Once the exchange is approved, Lux von Zollern will generate new digital files in the same sizes and formats as originally provided (500 MB, 100 MB, 50 MB, 10 MB, 5 MB, 1 MB in both PNG and JPG) and save them to a new 1 Terabyte external drive. This replacement drive will be shipped to the Purchaser within three (3) business days of exchange confirmation and payment (if applicable).
Lux von Zollern will also provide a new tracking number and shipment confirmation for the replacement drive.
c. Finality of Exchange
Once the one-time exchange is processed, it is considered final. No further exchanges or adjustments will be allowed.
10. SHIPPING, TRACKING, AND RISK OF LOSS
Lux von Zollern ships all external storage drives using trusted courier services, such as DHL, FedEx, or UPS. Upon shipping, a tracking number will be provided to the Purchaser via email.
a. Shipping Method
- All shipments are sent fully tracked and insured.
- Signature confirmation may be required at the time of delivery, depending on destination and value.
- Lux von Zollern will make reasonable efforts to ensure fast and secure delivery. However, delivery times may vary based on destination, customs clearance, and courier availability.
b. Transfer of Risk
Once the package is collected by the courier and a tracking number is generated, risk of loss or damage transfers to the Purchaser. Lux von Zollern is not liable for delays or damages caused by third-party courier services or customs authorities.
c. Lost or Damaged Shipments
In the unlikely event that a shipment is lost or arrives damaged:
- The Purchaser must notify Lux von Zollern immediately at luxvonzollern@gmail.com.
- A formal claim will be filed with the courier.
- Depending on the outcome of the investigation, Lux von Zollern may, at its discretion, issue a replacement shipment.
Please retain all packaging materials and photographs of the damaged package if applicable.
11. DATA PRIVACY AND SECURITY
As a luxury brand with elite clientele, Lux von Zollern prioritizes your privacy, confidentiality, and data security at every stage of the transaction.
When you make a purchase or otherwise correspond with us—such as by submitting your name, mailing address, telephone number, or payment details—you consent to Lux von Zollern’s handling and storage of this information for the sole purpose of completing and delivering your order, maintaining records, and providing client support.
a. Collection and Storage
The following Purchaser information is collected and securely stored:
- Full Legal Name
- Shipping Address
- Email Address
- Phone Number
- Purchase History
- Communication Records
Lux von Zollern does not collect or store credit card details. All payments made via credit card are processed through secure third-party platforms compliant with global PCI DSS (Payment Card Industry Data Security Standard) regulations. For wire transfers, Lux von Zollern only shares bank account details after receiving a direct email request from the Purchaser.
b. Use of Personal Information
We will never sell, trade, lease, or share your personal information with any third party, except:
- Where required to fulfill your shipment (e.g., courier services)
- Where legally required by court order, government agency, or regulatory authority
- To prevent fraud or enforce these Terms
Your privacy is fundamental to the exclusivity of your Lux von Zollern experience. We consider your trust a privilege and guard it accordingly.
c. Cybersecurity Measures
All digital artwork files are stored using high-level security protocols. Our digital infrastructure is built to defend against unauthorized access, theft, or loss of sensitive materials. Once your artwork files are prepared and transferred to the external drive, no online copies remain stored on publicly accessible servers. Every drive is formatted, encrypted, and scanned prior to shipment.
12. PERMITTED AND PROHIBITED USE
When you purchase digital artwork from Lux von Zollern, you are purchasing personal display rights only. You are not acquiring ownership of the intellectual property or copyright.
This section outlines your rights and restrictions as a Purchaser.
a. Permitted Uses
You are granted a non-exclusive, non-transferable, revocable license to:
- Display the artwork on personal digital devices in your home, gallery, or office
- Use the artwork for ambient decor or personal viewing in private settings
- Transfer the files between your own devices (e.g., from desktop to digital frame)
- Back up the artwork to a private, secure personal drive for safekeeping
These rights are granted solely for private use and enjoyment. They do not extend to commercial or public uses.
b. Prohibited Uses
The following actions are strictly prohibited:
- Commercial Use: You may not sell, advertise, market, promote, or commercially display the artwork in any capacity without prior written authorization.
- Alteration: You may not crop, edit, re-color, filter, or otherwise modify the digital artwork files. Doing so is considered tampering with the original creative vision and is prohibited.
- Mass Duplication: You may not replicate the artwork for mass digital distribution or file-sharing purposes.
- NFTs and Crypto Integration: You may not mint, tokenize, or represent Lux von Zollern digital artwork as a Non-Fungible Token (NFT), crypto asset, or blockchain asset under any circumstances.
- Public Upload: Uploading the artwork to public sites, online galleries, or any platform that enables downloads or copying is a violation of your license and Lux von Zollern's copyright.
Violating any of these terms constitutes a breach of this agreement and a violation of intellectual property rights, subject to immediate legal recourse.
13. DISCLAIMER OF WARRANTIES
To preserve the integrity of both the purchaser and the Lux von Zollern brand, the following disclaimers apply:
a. As-Is Delivery
All digital artworks and physical external drives are sold and delivered “as-is”, without warranties of any kind—either expressed or implied—including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
We guarantee:
- That the files you receive are those advertised
- That all digital files will open on standard photo/image viewers and display correctly on compatible devices
- That the files will be accessible, undamaged, and well-structured when delivered
However, we do not warrant that:
- The files will be compatible with all future technologies or devices
- Your personal hardware will display the artwork in precisely the same way as shown on our promotional visuals
- Third-party interference (e.g., computer viruses, malware) won’t affect your ability to access or display the files, if proper device precautions are not taken
b. Third-Party Compatibility
You are solely responsible for ensuring your devices (smart TV, frame, tablet, etc.) can support the display of high-resolution .jpg or .png files. Lux von Zollern is not liable for compatibility issues that arise from outdated software, unsupported formats, or device limitations.
14. LIMITATION OF LIABILITY
To the fullest extent permitted by law, under no circumstances shall Lux von Zollern, its founders, agents, affiliates, or successors be liable for any damages arising out of or in connection with your use—or inability to use—the purchased digital artwork files or external drive.
This includes but is not limited to:
- Direct or indirect damages
- Loss of profits or opportunity
- Data corruption or deletion
- Device incompatibility
- File format limitations
- Interruption of business
- Failure to meet aesthetic expectations
Lux von Zollern’s liability to any Purchaser shall be limited strictly to the original purchase price paid by the customer. No additional compensation, replacement, or refund will be considered beyond this amount.
15. INDEMNIFICATION
By purchasing and using Lux von Zollern artwork, you agree to indemnify, defend, and hold harmless Lux von Zollern and its agents from and against any and all claims, losses, damages, liabilities, legal fees, and costs arising out of or relating to your use, misuse, or breach of these Terms.
This includes any claim arising from:
- Unauthorized distribution of the digital files
- Commercial misuse or public display of the artwork
- Violation of third-party rights
- Legal disputes stemming from improper licensing or presentation
You also agree to cooperate fully in the defense of any such claim and not to settle any matter without our written consent.
16. GOVERNING LAW AND JURISDICTION
These Terms and Conditions, as well as any separate agreements whereby Lux von Zollern provides you with services or products, shall be governed by, interpreted, and enforced in accordance with the laws of the Province of British Columbia, Canada, without regard to its conflict of law principles.
You acknowledge and agree that:
- The agreement between you (the Purchaser) and Lux von Zollern is formed in British Columbia.
- Any legal action, arbitration, or proceeding arising out of or relating to these Terms must be brought exclusively in the courts located within British Columbia, Canada.
- By purchasing from lvzprestige.com, you irrevocably submit to the jurisdiction of such courts.
This clause is essential to ensure consistency, legal clarity, and a neutral venue for the resolution of any issues. Lux von Zollern Consulting Corporation is a Canadian company with operations officially incorporated in Coquitlam, British Columbia, and all matters of law will be subject to the rules and interpretation of this jurisdiction.
17. DISPUTE RESOLUTION PROCEDURES
Lux von Zollern is committed to resolving all concerns or disagreements in a manner that is respectful, professional, and client-focused. In the rare event of a dispute, the following resolution pathway must be followed:
a. Initial Contact
The Purchaser must first contact Lux von Zollern directly by email at luxvonzollern@gmail.com outlining the concern, issue, or complaint in detail. Please include:
- Your full legal name
- The date of your purchase
- A copy of your payment confirmation or receipt
- A detailed description of your concern
- Any supporting files or photographs (if applicable)
Lux von Zollern will respond within five (5) business days with an acknowledgment and a proposed course of action, if applicable.
b. Good Faith Resolution
Both parties agree to attempt to resolve the issue in good faith through open and respectful communication before initiating any formal complaint, claim, or litigation. Lux von Zollern will work to find a fair solution aligned with the brand’s values and commitment to excellence.
c. Mediation and Legal Action
If a resolution is not reached within 30 calendar days of initial contact, the parties agree to pursue confidential mediation conducted in Vancouver, British Columbia, before taking any legal action. All costs associated with mediation will be paid entirely by the Purchaser, unless otherwise agreed in writing.
Should mediation fail to yield an agreement, any further legal proceedings must be filed in the courts of British Columbia and will proceed according to Canadian legal standards.
18. NON-TRANSFERABILITY AND LIMITATION OF RIGHTS
The digital artwork license you acquire from Lux von Zollern is strictly personal and is issued to you—the original Purchaser—alone. It is not transferable to another person, entity, collector, organization, or commercial body without Lux von Zollern’s prior written consent.
You may not resell, gift, bequeath, sublicense, or otherwise transfer the artwork files or the physical external drive to any third party. Doing so would constitute a violation of both these Terms and applicable intellectual property law.
The only exception to this rule is in the event of estate inheritance, in which case Lux von Zollern may, at its sole discretion, grant limited rights for continued private use by the named heir, pending written request and formal documentation.
The exclusivity and prestige of Lux von Zollern’s clientele depend on maintaining strict control over who has access to and rights over each piece. By limiting transferability, we ensure that ownership retains its full value, rarity, and significance.
19. COMMUNICATIONS, CUSTOMER SUPPORT, AND OFFICIAL NOTICES
All official communication with Lux von Zollern must be conducted via the brand’s designated email address:

This email is used for:
- Purchase-related inquiries
- Wire transfer requests
- Exchange requests (as previously defined)
- Licensing clarifications
- Customer support follow-ups
- Courier tracking updates
- Formal notices regarding disputes or terms
Lux von Zollern does not conduct official business or support through third-party platforms, social media, SMS text, or phone calls unless otherwise arranged in writing. For security reasons, never share payment or personal information over any channel except email initiated from your verified address to the official inbox listed above.
All responses from Lux von Zollern will be provided in writing. This ensures a clear record of each transaction and supports the high standards of our service experience. Response time is typically within 2–5 business days, depending on the nature of the inquiry.
a. Notice of Delivery and Completion
The Purchaser will be informed by email when:
- Payment is confirmed and funds are received
- The external secondary drive has been assembled and sealed
- The courier has collected the shipment and the tracking number is active
We recommend saving each confirmation email for your records.
b. Customer Conduct
We ask that all communications remain professional and respectful. Lux von Zollern reserves the right to discontinue communication with any party displaying abusive, aggressive, or defamatory conduct. We are a prestige brand and insist on mutual dignity and decorum.
20. UPDATES TO TERMS AND CONDITIONS
Lux von Zollern reserves the right to update, revise, amend, or restate these Terms and Conditions at any time, for any reason, without prior notice. All changes become effective immediately upon being posted to www.lvzprestige.com under the Terms and Conditions section.
a. Applicability of Updates
The version of the Terms that governs your transaction is the version that was in effect at the time of your completed purchase. You will not be retroactively bound by changes made after the transaction has concluded.
If substantial changes are made that affect existing clients, Lux von Zollern may, at its discretion, notify prior purchasers by email of the update. However, the Purchaser is solely responsible for reviewing the most current version of the Terms prior to making any new purchases.
b. Continued Use as Acceptance
Any continued interaction with Lux von Zollern—such as future purchases, license requests, or website engagement—following an update to the Terms will constitute acceptance of the revised version. If you do not agree with any modifications, you must refrain from making additional purchases or contacting Lux von Zollern in connection with new orders.
21. FORCE MAJEURE
Lux von Zollern shall not be held liable or responsible for any delay or failure to perform any obligation under these Terms if such delay or failure results from circumstances beyond our reasonable control.
These may include, but are not limited to:
- Acts of God (such as floods, earthquakes, hurricanes, or wildfires)
- Civil unrest, insurrection, or war
- Acts of terrorism or sabotage
- Nationwide or regional power outages
- Postal or courier disruptions, delays, or embargoes
- Transportation failures or customs blockages
- Internet outages or third-party service disruptions
- Government mandates, lockdowns, or changes in law
In such circumstances, Lux von Zollern shall be entitled to a reasonable extension of time for performing its obligations. If the force majeure event persists for more than 60 calendar days, either party may choose to terminate the transaction by written notice. If termination occurs, Lux von Zollern will consider all obligations fulfilled once a full refund or suitable alternative is proposed or issued, if applicable.
This clause protects both the Purchaser and Lux von Zollern from being unfairly penalized for events entirely out of their control and ensures fairness in unforeseeable circumstances.
22. SEVERABILITY
If any provision of these Terms is determined to be unlawful, void, invalid, or otherwise unenforceable under applicable law, then that provision shall be deemed severable from the remainder of the Terms and shall not affect the validity or enforceability of any remaining provisions.
To the extent possible, the invalid or unenforceable provision shall be interpreted in a manner that reflects the original intent of the clause while still remaining in compliance with the law.
Lux von Zollern remains committed to upholding the spirit and structure of this agreement, even in the event a single section is deemed inapplicable or void by court or arbitrator review.
23. WAIVER
No waiver by Lux von Zollern of any provision, term, or condition set forth in these Terms shall be deemed a further or continuing waiver of such term or condition or any other term or condition. Any failure by Lux von Zollern to assert a right or enforce a provision shall not constitute a waiver of such right or provision.
A waiver shall only be effective if delivered in writing, signed by an authorized representative of Lux von Zollern, and issued specifically to the Purchaser in question. Verbal, implied, or informal conduct shall not constitute a valid waiver under any circumstance.
For example: if Lux von Zollern allows a single exception (such as a late payment extension or alternative delivery method) for one Purchaser, it shall not be assumed that such an exception applies universally, nor shall it alter the standard terms for future transactions.
24. ENTIRE AGREEMENT
These Terms and Conditions constitute the entire agreement between the Purchaser and Lux von Zollern concerning the purchase of digital artwork from lvzprestige.com, and supersede all prior or contemporaneous agreements, understandings, representations, or negotiations—whether oral or written.
You, the Purchaser, agree that:
- No other written or oral communication—whether promotional, marketing-related, or speculative—shall alter or amend these Terms.
- No third-party platform (such as social media, affiliate pages, or digital marketplaces) shall be relied upon in interpreting the scope of your rights or obligations.
- This agreement stands alone as the full and binding arrangement between the parties.
Should Lux von Zollern ever update or modify these Terms, such modifications will only apply to future purchases unless specifically stated otherwise in writing.
25. HEADINGS AND FORMATTING
The headings, section titles, and formatting elements (such as bullet points and numbered lists) used throughout these Terms and Conditions are for convenience and clarity only. They shall have no legal or contractual effect and may not be used to interpret or alter the substantive content of any clause.
All rights and obligations are established solely by the language of each provision, not by the structure or order in which it appears.
26. ACKNOWLEDGMENT AND CONSENT
By completing a purchase from lvzprestige.com, you—the Purchaser—affirmatively acknowledge and agree to the following:
- You have read and understood the full Terms and Conditions presented in Parts 1 through 5.
- You understand that the purchase involves digital artwork files, delivered via an external drive and not physical paintings, prints, or canvases.
- You accept that all sales are final, with no refunds under any circumstances.
- You understand that you are granted a non-transferable, non-commercial, personal-use license to view and display the digital files privately.
- You recognize and respect that all intellectual property rights remain with Lux von Zollern and that any unauthorized use, duplication, sale, or display constitutes a breach of this agreement.
